“Isa lang ang hindi mag-cooperate, that will be the stumbling block” said Judge Danilo S. Cruz upon sharing his thoughts on what may hinder the pursuance of Task Force Kalayaan at Katarungan (TFKK). Judge Cruz is the Executive Judge of the Regional Trial Court of Pasig. San Juan and Pateros is also part of his jurisdiction. Knowing that TFKK will help Persons Deprived of Liberty (PDL) a lot, he decided to talk about TFKK with other partner agencies.
Judge Cruz talked with the Jail Decongestion team of the Humanitarian Legal Assistance Foundation, Inc. (HLAF) last 2017 before meeting the partner agencies and discussed TFKK. He said that it is time to establish the TFKK in Pasig. Because of this, Judge Cruz partnered with HLAF in initiating TFKK and approved the meeting among the partner agencies.
He joined the prosecutors from prosecutor’s office, lawyers from Public Attorney’s Office (PAO), Bureau of Jail Management and Penology (BJMP) officers and HLAF team on the meeting last March 1, 2018 wherein they talked about the objective of TFKK. Concerns which may become a hindrance in the success of TFKK were raised such as the possible impacts of the plea bargaining to the revised penal code, the increasing number of cases they are handling, the congested jails, and the reason why hearings are being postponed causing numerous pending cases. He acknowledged these concerns and tried to give solutions by asking the other parties if there are any help they can offer. Also, he shared his thoughts regarding as to how the partner agencies can assist each other.
The meeting gave a clearer definition of the problem and Judge Cruz finds it helpful because now that the issues were addressed it will be easier to figure out what the next step should be. “The fact na defined na yung problem, madali dali na.” he said.
For Judge Cruz, cooperation of the partner agencies is essential for TFKK to succeed in helping PDLs. If there is one agency which wouldn’t cooperate, TFKK will be highly affected and more likely, failure will occur. “There must be a cooperation of those four,” said Judge Cruz pertaining to the court, prosecutor’s office, PAO, and BJMP. Therefore, he is expecting full cooperation from everyone.
Meeting the partner agencies was only his first step in supporting the pursuance of TFKK. As for his next step, he will discuss the pursuance of implementation of TFKK on his meeting with the other judges.
